Social Care Recruitment Services for Care Providers
Effective Date: 28 May 2026
1. Introduction
These Terms of Service (“Terms”) govern the recruitment and staffing services provided by Insourc.co.uk (“Insourc”, “we”, “our”, or “us”) to care providers, healthcare organisations, supported living services, domiciliary care agencies, nursing homes, residential care homes, and related organisations (“Client”, “you”, or “your”).
By requesting candidates, booking temporary staff, interviewing introduced candidates, or otherwise engaging our services, you agree to these Terms.
2. Services Provided
Insourc provides recruitment and staffing services within the health and social care sector, including but not limited to:
- Temporary staffing
- Permanent recruitment
- Contract recruitment
- Care assistants
- Support workers
- Senior carers
- Team leaders
- Registered managers
- Specialist social care staff
3. Service Disclaimer
Insourc acts solely as a recruitment intermediary between Clients and candidates/workers.
While we take reasonable steps to assess suitability, qualifications, references, right to work status, and compliance documentation, Insourc does not guarantee:
- The ongoing suitability of any candidate or worker;
- Continuous availability of staff;
- Performance, conduct, attendance, or compatibility;
- That a worker will meet all expectations of the Client.
The Client remains fully responsible for:
- Supervision and management of workers;
- Staff induction and training;
- Clinical and operational oversight;
- Safeguarding procedures;
- Compliance with CQC and applicable care regulations.
Insourc shall not be liable for losses, damages, incidents, negligence, misconduct, or omissions arising during the placement or engagement of any worker supplied.
4. Candidate Compliance
Insourc will aim to ensure workers have completed appropriate compliance checks where applicable, including:
- Right to work checks
- DBS checks
- Employment references
- Mandatory training
- Professional registration verification (where required)
The Client is responsible for confirming suitability for the specific role and work environment.
5. Bookings and Cancellations
Temporary Staff Bookings
Bookings may be made verbally, by email, telephone, or via agreed booking systems.
Cancellation Charges
The following cancellation charges may apply:
- Less than 24 hours’ notice: up to 100% of booking fee
- 24–48 hours’ notice: up to 50% of booking fee
Where a worker has already attended the assignment location, the full agreed charge may apply.
6. Fees and Payment
- Fees will be agreed in advance or outlined within the applicable rate schedule.
- Invoices are payable within 14 days unless otherwise agreed in writing.
- Late payments may incur statutory interest and debt recovery costs.
- The Client may not withhold payment due to unrelated disputes.
7. Introduction Fees
An introduction fee becomes payable where:
- A Client employs or engages a candidate introduced by Insourc;
- The candidate is hired directly or indirectly;
- The engagement occurs within 12 months of the introduction date.
An “introduction” includes:
- CV submission,
- Candidate referral,
- Interview arrangement,
- Temporary assignment,
- Candidate details shared by Insourc.
The introduction fee applies regardless of whether the engagement is:
- Permanent,
- Temporary,
- Contract-based,
- Self-employed,
- Through another agency or third party.
Fee percentages and terms may be outlined separately within commercial agreements or schedules.
8. Transfer Fees
Where a temporary worker supplied by Insourc is subsequently employed directly by the Client or through another business during an assignment or within 12 weeks after the assignment ends, Insourc reserves the right to charge a transfer fee in accordance with applicable recruitment legislation.
9. No Guarantee Clause
Insourc does not guarantee:
- Candidate acceptance of employment offers;
- Duration of employment;
- Worker attendance or continuity;
- Suitability beyond information reasonably verified;
- Specific business outcomes resulting from placements.
No warranty or guarantee is provided regarding:
- Candidate performance,
- Reliability,
- Conduct,
- Retention,
- Availability,
- Fitness for a particular purpose.
All recruitment services are provided on a reasonable endeavours basis.
10. GDPR and Data Protection Consent
Both parties agree to comply with the UK GDPR, Data Protection Act 2018, and all applicable privacy legislation.
By submitting vacancy details or receiving candidate information, the Client agrees:
- To process personal data lawfully and securely;
- To use candidate information solely for recruitment purposes;
- Not to share candidate CVs or personal data with third parties without consent;
- To maintain confidentiality of all candidate information.
By applying for vacancies or registering with Insourc, candidates consent to:
- Their personal data being processed for recruitment purposes;
- Their details being shared with prospective employers and care providers;
- Compliance and identity checks being conducted where required.
Insourc will retain and process personal information in accordance with its Privacy Policy.
11. Confidentiality
Both parties agree to keep confidential all commercially sensitive, operational, candidate, and client information obtained during the business relationship.
This obligation continues after termination.
12. Limitation of Liability
To the maximum extent permitted by law:
- Insourc shall not be liable for indirect or consequential losses;
- Insourc shall not be liable for loss of profits, business interruption, reputational damage, or regulatory penalties;
- Total liability shall not exceed the total fees paid by the Client to Insourc within the previous three months.
Nothing in these Terms excludes liability where exclusion is prohibited by law.
13. Safeguarding
The Client must immediately report any safeguarding concern, allegation, complaint, incident, or serious misconduct involving supplied workers.
Both parties agree to cooperate fully with safeguarding investigations and regulatory obligations.
14. Termination
Either party may terminate services by written notice.
Termination shall not affect:
- Outstanding invoices,
- Existing obligations,
- Confidentiality duties,
- Introduction fee entitlements,
- Accrued legal rights.
15. Force Majeure
Insourc shall not be liable for delays or failures caused by circumstances beyond reasonable control including:
- Severe weather,
- Illness outbreaks,
- Government restrictions,
- Industrial disputes,
- Technology failures,
- Transport disruption.
16. Governing Law
These Terms shall be governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
